Mother Files Lawsuit After Parasail Accident

Wrongful Death, Personal Injury Suits Filed

The mother of a 15-year-old girl who was killed and her sister injured in a parasailing accident at a Pompano Beach resort announced the filing of lawsuits against the parasail operators and the resort.

Shannon Kraus was overcome as she entered a room and saw pictures of her daughter, Amber, placed on easels at the Miami office of Leesfield Leighton & Partners where the press conference was held.

John Leighton announced the filing of a wrongful death and personal injury lawsuit against the Island Waves Parasail and the Wyndham Vacation Resort. The vacation resort was named in the lawsuit for recommending and arranging the trip for Amber and her sister, Crystal, according to Leighton.

According to the medical examiner's office, Amber White was officially pronounced dead at 6 p.m. Aug. 19. The family requested to donate her organs, and for that reason, her body remained on life support for three days.

Her 17-year-old sister, Crystal, was injured, treated and released from North Broward Medical Center.

Broward Sheriff's Office investigators said the accident occurred when a 28-foot boat owned by Island Waves Parasail, a Palm Beach Gardens company, was pulling the girls on a parasail the afternoon of Aug. 18.

According to the boat captain, the winds suddenly increased from 15 to about 40 mph. Due to weather conditions, the hydraulic winch was no longer strong enough to bring down the parachute and the wind pulled the boat to shore, where Amber and Crystal remained suspended over the beach for about two minutes, according to the BSO.

The parachute then began to spin out of control and the line broke, sending the teens onto the roof of the Beachcomber Hotel and Villas and through several trees in the courtyard, where they were found dangling.

Leighton said that Island Waves Parasail had improper equipment, its driver had improper training and that the company shouldn't have been had the girls out on the trip that day because of the weather. He also said that at one point the girls told the boat driver they wanted to "come down and the operator refused to do so."

"Whatever the jury will award. What we plead is the minimal jurisdictional amount which is in excess of $15,000. We don't plead a specific amount because at this time we can't answer that and that will really be up to a jury in Broward County," said Leighton.

The two were vacationing in the area from Ocala.
