Relatives Said Police Arrested The Wrong Man

BAL HARBOUR, Fla. – As 32-year-old bodyguard Ryan Hubbard sat in a jail cell Saturday night charged with two counts of attempted second degree murder, his sister, Krystal Hubbard, told Local 10 that police had the wrong man.

"He didn't do this. He wasn't even near the area," said Krystal Hubbard.

She said her brother, who lives part time in Miami, was actually in Ohio with his pregnant girlfriend.

"He was at the doctor's office, he went to the bank, he has plenty of receipts to prove it," said Hubbard.

It was in Ohio on Friday night that U.S. Marshals found and arrested Hubbard after a multi-agency search that lasted three days. Police say eye witnesses placed Hubbard at the Bal Harbor shopping mall along with his boss, Haider Zafar, during the time of the shooting.

According to an affidavit, Hubbard used a semi-automatic to shoot Kris Bortonovsky in the knees as he dined at Carpaccio's restaurant. A 90-year-old woman dining nearby was shot in the foot.

Hubbard and Zafar were reportedly at Bal Harbor to confront Bortonovsky about an earlier dispute. Hubbard and Zafar allegedly fled after the gunfire erupted.

Hubbard remains in police custody in Ohio. Zafar, who had also been on the run, was arrested Saturday morning on unrelated fraud charges. Bal Harbor police are labeling him a person of interest in the restaurant shooting. Meanwhile Krystal Hubbard hopes the truth comes out.

"He's 6 (feet) 5 (inches tall) and weighs over 400 pounds. He can't run," she said.

It's unclear when Hubbard will be extradited to Miami. Both victims are OK and recovering from their wounds.
