The lawsuit filed yesterday against Ted Morse in the Scott Rothstein Ponzi case also names the Ed Morse Automotive Group as a defendant.

But emails included in the lawsuit indicate the 90-year-old Morse, who built one of America's largest automobile empires after humble beginnings as a Miami hotel doorman, was being devastated by Rothstein's financial shenanigans.

Rothstein allegedly coerced Ed Morse to post $57 million in bonds in a scam involving a civil case in which Rothstein forged court documents. Ed Morse currently owns eleven car dealerships in South Florida and throughout the state, but once owned several more.

Rothstein at the time was representing Ed Morse and his wife Carol in a civil suit. The lawsuit filed yesterday against Morse claims that Morse's son, Ted, was in cahoots with Rothstein in that fraud as well.

The pair's goal, according to the lawsuit, was to use Ed Morse's money to keep the Ponzi afloat long enough to get all the family's money back, plus a $40 million profit.

In all the Morses put about $100 million into the scheme, according to Scherer, and had a net loss of about $20 million.

Rothstein, who is in his third day of closed-door depositions this morning in a Miami courtroom, testified on Monday that Ted Morse was a "charter member" of his massive billion-dollar fraud, said Scherer.

The financial shenanigans played at Ed Morse's expense were "slowly killing the man," according to an email sent by his wife Carol to Rothstein just six weeks before the Ponzi scheme collapsed.

Here are the emails in their entirety between Carol Morse and Scott Rothstein:

I do not understand why you insist on being nasty to me every time we speak or you write. I have never been nasty to you. Not once. I havé not always been pérfect... far from it ât times.... but I am using every ounce of power that I have and every favor that I am owed to try to help you and ed and the company. Same with your brother in law. Whenever you had a family emergency I was always there. When you called in the middle of the night for me to help John l jumped on it. I never charged them a pênny because if they are your family they are my family.
I did nothing with the lRS. I have not had contact with them and am not to have contact with them. The orders we have are crystal clear. The court handled that issue. Federal courts have such jurisdiction. I do have friends that work there and they have been helping me in guiding me through the issues. I also employ 3 former IRS agents that also have contacts there. But I do not have direct contact with them and will not.
And I did nothing with the court other than what I had been doing all along....trying to get in front of a
compassionate patient judge that would do the right thing. lf you want to speak to someone who can tell you
exactly what occurred other than me please call ted. He was there.
I am in the middle of talking to the attorney on your brother in laws case, then I need to call him and then I will
update you on jones. I am trying to get back in circuit court today with Ted just as we did yesterday with the federal courts. Ted makes a very effective witness in regard to the company and what it has been like being dragged around through the court system. I am not going into court without someone else present unless I have to. I do not want there to be any confusion as to what was done and what was said. lf you would like to come down here and attend court with me, I would be happy to have you. I think we do very well together. At least we have until this point and I expect that over the next few weeks we will accomplish the remainder of our goals with Maine. Ask ted what occurred yesterday. Candidly, I am shown tremendous deference in the Courts. lf we can get before a judge today and you would like to appear by phone you are more than welcome.
I apologize again if I have disappointed you in some way. But I will do as I promised, I will complete the case and insure that you have a full and complete recovery. I am supposed to speak to Omni's attorney at 1 pm today. lf you have any into for me in that regard i would appreciate it. And I would truly like you to be on that call with me so there is no mistaking what is occurring on that issue.
Be well,
And whether you believe it or not I do love you and Ed, please do not be nasty to me and please do not try to harm me or my firm or my family. lt serves no useful purpose. You have thé power to cause great harm to me and my family and my firm. I have called in many favors on behalf of you and ed and ted over thé last several years, including the one with the sheriff and your brother in law. Attempting to harm me with [sic] harm a lot of other people. I ask you sincerely to just let me finish the job I started.
With much love,
Scott

Good Evening Scott and Ted,
I want to share a growing concern of mine. Everyday I can see the effect of the stress on Ed of losing his wealth.
The anguish he is feeling over the bond money, the settlement of the cases, and everything he has worked his
whole life to accumulate-is slipping away from him, out of his control. I am sure you are aware of how this is
affecting Ed, but I would feel negligent if I did not point out that the stress is slowly killing the man. 1f there is
anything you can do to bring all this to a close in a quick manner, I would very much appreciate it. The gmpty
prómisesthat he gets on a iegular basis is really effecting his physical health and his life. lt is very painful to watch
what this is doing to Ed on a daily basis.
Thank you,
Carol

Carol,
I fully understand your concern and will do everything possible to speed this up. I will not let Ed lose one penny.
The'order that we received from the hearing last week that ted testified at was quite specific about Ed receiving all the bond money no later than the 30th. I have taken certain steps to insure that nothing interferes with that date.
Additionally, I wìll attempt to appear before the same judge again tomorrow or tuesday and see what I can do to
move the date up the 16 days.
l will call u before noon to update u.
lf u wish u can call me before that and as I advised, if u wish to speak tonight I will be working until approx 1 am.
With much love to u and Ed,
Scott
