Toby Duncan charged with sexual battery

POMPANO BEACH, Fla. – Police on Wednesday arrested an 18-year-old boy accused of locking a fellow high school student in a bathroom stall and molesting her.

The Broward Sheriff's Office charged Toby Duncan with sexual battery, lewd battery on a victim younger than 16, lewd molestation on a victim older than 12, and false imprisonment.

The incident happened at Blanche Ely High School on Tuesday morning, where Duncan is a student.

Police said Duncan grabbed the girl by the arms and forced her to walk down the school hallway towards the boy's restroom. When she resisted him, he picked her up and carried her.

Once inside, Duncan pushed the girl into a stall and molested her, according to the arrest affidavit.

"You attempted to pull down her pants, grabbed her buttocks, hips, touched her private area over her clothing," said Broward Circuit Court Judge John Hurley.

When the girl tried to escape, police said, he would push her back and hold her hands together. Police say Duncan then exposed himself to her.

A security guard eventually entered the restroom and stopped him. Duncan ran off but was later arrested.

The victim told police that Duncan had been violent with other students in the past, according to the arrest affidavit.

Hurley ordered that Duncan be held without bond.
