Did bus driver violate protocols?

Jerry Cunningham listed in critical condition; Bus driver Reinaldo Soto on administrative leave

DANIA BEACH, Fla. – The Broward County Transit bus driver may have violated at least two rules of the Florida Administrative Code, which details the state standards public bus drivers are expected to follow, when he ran over a 14-year-old boy.

Reinaldo Soto, 55, was placed on administrative leave while county transit administrators investigate the incident.

Soto was driving the bus that ran over Jerry Cunningham (pictured right) on Friday morning. The teenager is in a medically-induced coma and remains in critical condition, according to attorneys for his family.

The Florida Administrative Code states a bus should not be operated when the door is in the open position. Video shows the doors were still open when the bus pulled away, but then closed when Cunningham ran up and stuck his arm inside.

The code also states passengers shall not be permitted in the stepwell, or any area forward of the standee line, when the bus is in motion. Video shows two people who may have blocked Soto's view of Cunningham standing in the area.

Local 10 obtained Soto's county driving record. It listed 11 accidents -- three were ruled preventable; twice he clipped another bus; and, once he hit a car. None of the accidents resulted in injuries.

Soto has been a bus operator with Broward County Transit since Feb. 2002.
