MIAMI ā€“ A hearing was held Wednesday for the 15-year-old son of Canada's consul general on whether or not the teen should be allowed to be released on bond before trial.

Marc Wabafiyebazu, 15, was allegedly involved in a drug deal that turned deadly, killing his older brother.

Miami police Detective Rolando Garcia took the stand Wednesday and painted a different picture of the calm defendant sitting inside court.

"He was aggressive, violent and spit at me," Garcia said.

The defense has stated Wabafiyebazu was clueless to his brother Jean's intentions to rob some drug dealers, but in surveillance video played in court, it appears the defendant was on lookout before the shooting occurred.

The teen's lawyers are trying to get bond for the Canadian consul general's son in the drug deal gone bad that left his brother and a drug dealer dead. He is now facing double homicide charges as an adult.

Wabafiyebazu's mother was inside the courtroom, but is on the witness list, so she refused to talk to reporters.

Even though Wabafiyebazu had gun powder residue on his hands, his lawyer said he shot into the air to get police attention and save his brother's life.

"At any point in the video does Marc take a shot with a loaded Smith and Wesson handgun he is holding at Anthony Rodriguez?" asked Michael Cory, Wabafiyebazu's lawyer.

"Not that is captured on video. No, sir," Garcia said.

Local 10 has also learned Miami police never interrogated Wabafiyebazu, but they claim he made some sort of statement of confession to Officer Juan Valez, who took the defendant to police headquarters, but the defense has a problem with that alleged admission, because their client had not been read his rights.

Wabafiyebazu was calm inside court Wednesday, but detectives said when Wabafiyebazu was told his brother, Jean, was dead, he became belligerent.

"As I was leaving, he threatened me and told me he was going to blow my head off," Garcia said.
