Lawsuit claims stabbing suspect raped by 2 football players at former school

17-year-old girl accused of stabbing football player at Miami Killian Senior High School

MIAMI-DADE COUNTY, Fla. – A lawsuit from November 2014 shows that a 17-year-old girl accused of stabbing a classmate at Miami Killian Senior High School had accused two football players of raping her at her former school in Homestead last year.

Attorney Jeffrey Herman filed a lawsuit against USA Charter and Keys Gate High on behalf of the teen who said she had been raped by two football players. Police have not confirmed those allegations.

According to the lawsuit, the teen claimed two boys dragged her from the girls' bathroom in April 2014 and then took her to an administrator's office, where they forced themselves on her.

The girl's mother told Local 10 News that her daughter has not been the same since and has suffered from depression.

According to an arrest report, the suspect was found with additional weapons in her book bag when she was arrested Tuesday at Miami Killian Senior High School.

Miami-Dade school police said two additional kitchen knives and a large fork used for grilling were found in the suspect's bag.

On Wednesday, a judge ordered that the teen remain in juvenile jail for the next 21 days while prosecutors determine whether to charge her as an adult.

Local 10 News reporter Michael Seiden said the suspect appeared "out of it" during the hearing, where she was accompanied by a court-appointed attorney and her mother.

The teen was taken into custody Tuesday on charges of attempted felony murder and possession of a weapon on school grounds.

Police said she stabbed a 15-year-old boy, identified by students as DeAndre Johnson, in the school cafeteria.

Johnson, a defensive end on the school's football team, was taken to Nicklaus Children's Hospital, where he underwent surgery to repair a pierced lung and artery. His family told Local 10 News that Johnson is breathing on his own and is alert and talking. The hospital also confirmed that he is in good condition.

On Wednesday, prosecutors asked the judge to consider holding the suspect on attempted second degree murder charges.

Meanwhile, Miami-Dade County Public Schools Superintendent Alberto Carvalho met with students and teachers at the high school on Wednesday morning, and also sat down with the football team.

Carvalho left a school board workshop briefly to speak with reporters about security at Miami-Dade public schools.

"We have a responsibility ensuring safety and security of students and that's a work in progress always," said Carvalho. "We're one of the few school systems in America that has its own police department. In addition to having a deputized police force and security guards and trust counselors to obtain information, we have a random weapons search program conducted with metal detectors by our police officers."

According to Johnson's father, Andre Johnson, his son did not know the suspect before the incident other than sharing a class together.
