Man Accused Of Abusing 5-Month-Old

Doctors: Baby Shaken, Had Broken Legs

OAKLAND PARK, Fla. – An Oakland Park man is arrested, accused of abusing his 5-month-old son.

According to an arrest affidavit, 38-year-old Paul Garry Day called 911 last Thursday when his baby stopped breathing. Police said the child had been crying and Day shook him.

The baby was taken to Holy Cross Hospital and then to Joe DiMaggio Children's Hospital, where doctors determined that the child's injuries were consistent with shaken baby syndrome, according to the arrest affidavit.

Police said Day also told them he had dropped the baby the week before and that when he grabbed the child by the legs he "heard a noise." Doctors found fractures in both the baby's legs, according to the arrest affidavit.

Detectives said Day did not seek medical attention for the baby in that incident and did not tell his wife.

Day was arrested Tuesday and charged with aggravated child abuse and child neglect. He was taken to the Broward County Jail, and his bond is set at more than $13,000.

The child remains in critical condition.
