MIAMI BEACH, Fla. – The Miami Beach Police Department has released a redacted report about its investigation into former NFL star Darren Sharper.
As Local 10 News was first to report Wednesday, police confirmed Sharper is under investigation on suspicion of sexual battery. Spokeswoman Vivian Hernandez said the filing date was just last month, but she said details could not be released since it is an "open" investigation.
Sexual battery in Florida is defined as "oral, anal or vaginal penetration by, or union with, the sexual organ of another or the anal or vaginal penetration of another by any other object; however, sexual battery does not include an act done for a bona fide medical purpose."
The new case was filed two days after Sharper was arrested in California on allegations that he raped and drugged two women. He could face more than 30 years in state prison if convicted.
The Los Angeles Superior Court told Local 10 his arraignment and plea entry is scheduled for Thursday afternoon. It had been continued from original scheduled date of Feb. 14.
Los Angeles County District Attorney's Office spokesman Ricardo Santiago also confirmed Thursday that state prosecutors will be asking a judge to raise his bail to $10 million given that there are cases pending in Arizona, Nevada and Louisiana. To date, he is accused of raping seven women and drugging 11 others in those four states. There is also now the open investigation in Miami Beach.
Santiago said that if a judge rules to raise his bail to $10 million, he would be remanded into custody immediately.
Local 10 obtained Sharper's complaint from the Los Angeles County District Attorney's Office.
In it, Local 10 has learned Sharper is accused of drugging and raping two women -- one last month and another in October 2013.
He was also charged with four counts of furnishing a controlled substance and one count of possession of a controlled substance, all felonies announced by the Los Angeles County District Attorney's Office.
The controlled substances, according to the complaint, were zolpidem and morphine.
In both the October and January incident dates, the Los Angeles County District Attorney's Office complaint said Sharper met the victims at a West Hollywood nightclub, invited them back to his hotel and that the women passed out after taking a shot Sharper provided them.
It is a storyline eerily similar to what some women on Spring Break in Miami Beach in 2011 said happened to them.
In that 2011 incident in Miami Beach, the women filed a complaint against Sharper.
One of the women involved told Local 10 that, after a night of partying at South Beach nightclubs, they were invited to Sharper's South Beach condominium by a friend.
"We ended up falling asleep on the couch and I woke up to Darren and one of his friends around me, whipping out their genitalia in front of me," she said.
"At this point she advised him to leave her alone, and he complied," reads the report.
Then she passed out again, waking up to find the same man, "(either Darren or Jamie) attempting to lift her dress." After slapping his hand away, the report states, she woke up her friend and then both realized their underwear was missing.
"The complainants made their way to the living room area and noticed their underwear laying on the floor by the couch," the report said.
"I was terrified and I knew I needed to get out of there as soon as possible," one of the women told Local 10 in a telephone interview.
"Do you think he drugged you?" asked Local 10's Christina Vazquez, to which she replied, "I mean, we were all drinking at his hotel, so it is definitely possible."
She and a friend did go to the rape treatment center at Jackson Memorial Hospital.
"We went there because we knew that we had been touched," the woman said.
The report shows DNA was collected and an examination was performed, but the report states the doctor who examined them "did not find any evidence of sexual battery on either complainant. … At this point there is no evidence indicating that a sexual battery took place."
"There's not much you can do. It's sad," she said over the phone. "And you just have to learn from the experience, and I definitely have my guard up. I definitely don't trust people the way I used to. It's really an eye-opening experience to see what kind of people are in this world."
This interview, she said, was the first time she's talked publicly about the incident.
She said she gathered the courage to talk in hopes her voice will support the women who will have to face Sharper in a courtroom and to give strength to those perhaps struggling to come forward.
"I just hope that this helps stop anything else from happening in the future, that it doesn't happen to any other girls, that they might actually believe that this is really something that this man has done to women out there," she said. "He was a man of money and he felt like he was privileged, and I think he just never thought anything would come about it."
In a news release, the Los Angeles County District Attorney's Office said that on Oct. 30, 2013, Sharper met two women at a West Hollywood nightclub and invited them to another party.
"On the way, Sharper allegedly told them he had to stop by his Los Angeles hotel room to pick something up and invited both women up," the release said. "While there, he allegedly gave each woman a shot. Each woman passed out. Jane Doe No. 1 allegedly woke up naked hours later with Sharper sexually assaulting her. The second woman awoke and 'interrupted his actions.'"
The Los Angeles County District Attorney's Office said in the Jan. 14 incident, Sharper met two separate women at the same West Hollywood nightclub, invited them to another party, stopped at his hotel first, he "allegedly invited both up to his room, offered them a shot and each passed out. When they woke up hours later on Jan. 15, one woman believed she'd been sexually assaulted. Both women left his hotel and sought medical treatment."
His arrest in California comes four years after Sharper wrote an essay in a 2010 book called "NFL Dads Dedicated to Daughters."
"Recognizing that domestic and sexual violence directed against women is a serious social problem that continues to plague America, the National Football League Players Association has joined with A Call to Men, the leading national men's organization dedicated to addressing this problem, to produce NFL Dads Dedicated to Daughters," the book's description states.
USA Today reports that Sharper wrote in part, "My daughter makes (me) mindful of how women are treated, undervalued and exploited, which is why I felt compelled to take advantage of this opportunity to speak up about domestic violence."
Sharper played 14 seasons in the NFL with the Green Bay Packers, Minnesota Vikings and for the New Orleans Saints team that won the Super Bowl after the 2009 season. He is also a five-time Pro Bowl player.
