Parents accused of leaving toddler in hot SUV denied custody of children

FORT LAUDERDALE, Fla. – A couple accused of leaving their 11-month-old boy in a hot SUV last month appeared in court Monday morning.

According to police, the toddler died after his parents forgot him inside their vehicle after returning home from grocery shopping in Lauderhill.

During Monday's hearing, a judge set forth future mediation dates for Elaine and Kenneth Weaver, although neither has been formally charged in the case. A mediation hearing is scheduled for Aug. 24.

The judge also ruled that the couple's four other children remain in the custody of relatives at this time.

Detectives said they have yet to refer the case to the state attorney's office and are awaiting autopsy results from the medical examiner's office. They said the boy was in the vehicle for about an hour before he was found.

The parents called 911, but despite efforts by rescue units, the boy was pronounced dead at a hospital.
