Police: Kaepernick, 2 NFL players linked to Miami sex assault investigation

Sexual assault allegedly took place at the Viceroy Hotel in Brickell

MIAMI – Miami police were investigating sexual assault allegations involving several NFL football players and a woman who said she was San Francisco 49ers quarterback Colin Kaepernick's lover.

The unidentified woman told police she didn't know how she ended up in a hospital the morning after she went to an apartment on the 47th floor at the Viceroy Hotel in Brickell to see Kaepernick.

San Francisco 49ers Quinton Patton, 23,  and Seattle Seahawks wide receiver Ricardo Lockette were also at the apartment, the woman told police. On the night of April 1st, she mixed drinks and served shots. They told her that they would drink the shots if she smoked marijuana, an  incident report stated.

The three athletes -- who are not suspects in the case -- have been successful with the NFL. During his first two seasons with the 49ers, Kaepernick lead his team to the Super Bowl. Lockette signed with Seahawks in 2011 after playing at Wallace State Community College. And Patton finished his first season with the 49ers last year, after playing with Louisiana Tech.

Kaepernick has celebrity status. His tattooed muscles have been on the cover of GQ and on ESPN. In the Miami Beach social scene, Kaepernick was rumored to be dating Teyana Taylor, 23, a singer with Kanye West's label. And he has also been seen with super model Chanel Iman at the Fountainebleau Hotel.

TMZ was the first to report the story attributing it to a law enforcement source. Police released the incident report Thursday. Here is what the unidentified woman told police, after she woke up at  the hospital:

They were watching a basketball game. She began to feel light headed, so she went to one of the two bedrooms in the apartment. Kaepernick, 26, followed. They kissed, as he undressed her. Suddenly he stopped and left the room.  Patton and Lockette, 27, opened the door. She was naked.

She shouted: "What are you doing? Where is Colin? Get out!" They complied.

And then there was a black out. She woke up in a hospital with no idea how she got there. A day later, a Miami police officer referred her case to the special victim's unit.

Police have not made any arrest or filed any charges in the case.

"The 49ers organization is aware ... and is in the process of gathering the pertinent facts,"  San Francisco 49ers General Manager Trent Baalke said in a statement.

On April 2nd, Ricardo Lockette posted a video working out at the Viceroy 's spa with a caption: "Thought I'd come get my ProDay on"

On April 4th, Kaepernick posted a photo taken at the Viceroy's spa on Instagram with a caption: "Get yo body right!"
