Newly obtained search warrant says receipt for alcohol found in pocket of boater

MIAMI BEACH, Fla. ā€“ A newly released search warrant affidavit says Marlins pitcher Jose Fernandez and the men he was boating with on the morning they died had a strong odor of alcohol on their bodies when they were recovered.

According to the search warrant affidavit, an associate medical examiner who performed the autopsies after the Sept. 25 crash said "all three bodies, individually, had a strong odor of alcohol emanating from them."Ā 

The Miami HeraldĀ was the first to report the findings.

Fernandez and the two men, Emilio Macias and Eduardo Rivera, were in the pitcher's boat, a 32-foot SeaVee, when it struck a jetty off Miami Beach.

According to the report, the affidavit also states that the boat, "Kaught Looking," was going at a high rate of speed and that the driver of the vessel was driving with "recklessness" that was "exacerbated by the consumption of alcohol."

The affidavit also confirms that the three men were at a bar in the morning hours of Sept. 25 and that a receipt for alcohol purchased was found in the pocket of one of the occupants.

The name of the occupant was not released.

Fernandez and the other men were known to have been at American Social Bar & Kitchen in the Brickell area hours before the crash.

Toxicology reports have been completed but not released by investigators.
