David Giraldo says two bodyguards attacked photographer inside Miami Beach Subway

MIAMI – Recording artist Justin Bieber didn't appear at Wednesday's hearing in Miami-Dade County regarding a lawsuit filed by a paparazzo who claims he was attacked by the singer's bodyguards last year.

After skipping three depositions, the star witness in the pending lawsuit finally showed up to court. David Giraldo said he was working an overnight shift at a Subway restaurant, when the photographer  ran inside asking for help.

"I don't hate the guy," Girlado said. "I like his music. I was always a fan…I didn't know this was going to be such a big deal. I wasn't even showing up to the meetings because I don't want anything to do with this."

The incident in question happened Jan. 23, 2014, at the restaurant on Washington Avenue in Miami Beach.

"He comes in screaming for his life. The first thing I did -- I had my phone in my hand and so I pressed record," Giraldo said.

Giraldo claims two men believed to be Bieber's bodyguards followed the photographer into the restaurant. He said one of the men locked the front door, so no one could get inside

"They came in and they went and harassed him in the back," Giraldo said. "I couldn't see what was going on."

"In this situation , Justin Bieber was leaving Set nightclub on Miami Beach when Manuel Munoz took a picture and was not very close to him, and then Justin Bieber ordered his bodyguards to chase Manuel Munoz down the street into the Subway restaurant on Washington Ave.," attorney Mark DiCowden, who is representing Munoz said.

DiCowden claims the bodyguards attacked his client, leaving Munoz with significant injuries.

"They roughed up Manuel Munoz. They hurt him all around his body. His knees, his back and his head and his neck," DiCowden said.

Bieber settled another lawsuit last year with a different photographer who claimed he was assaulted by Bieber's body guards outside a recording studio.

Bieber was arrested on suspicion of DUI that same night after allegedly racing a Lamborghini on Miami Beach.

Bieber's attorney declined to comment on the lawsuit.
