Prosecutors say viral video of alleged dog abuse is not evidence of crime

Viral video of woman's interaction with dog prompts investigation

MIAMI – Lenka Herejkova and other animal advocates reported a woman at the Opera Tower in downtown Miami was abusing her German Shepherd.

Herejkova told Miami police officers she and others believed the woman was punching and hitting the dog.

Miami-Dade County Animal Services investigated, but the state attorney's office determined there wasn't enough evidence to file animal cruelty charges. 

Herejkova said in a Facebook post that "no one did anything to help this poor dog."

Prosecutors reviewed a video Herejkova shared of the woman's interaction with her dog at the apartment's balcony. Animal advocates shared it at least 3,847 times on Facebook.

"The woman appears to be cleaning up a mess left by the dog," state attorney's office spokeswoman Terry Gonzalez-Chavez said in a statement. "At one point it appears that the woman makes contact with the dog, but it is impossible to tell the degree of force utilized."

Herejkova said the woman was having the dog eat the feces. Investigators and prosecutors believe the video does not show pain and suffering. 

"The dog was in good shape and there was no evidence of injury or neglect such that the dog suffered injury or death," Gonzalez-Chavez said. 

She added they are not condoning the behavior Herejkova reported, but they don't believe the evidence equates to their ability to prove a criminal charge.
