Business Owner Offers Prayers, Not Refund
Problem Solvers Look Into 'Best Windows'

BROWARD COUNTY, Fla. -- The Problem Solvers have a consumer warning about a business with a conflict between religion and refunds.Michael Duncan says he is owed big bucks for a set of doors with impact-proof glass that he was supposed to have installed months ago, but never received.Duncan said when he tried to get a refund, the man who was supposed to install the doors told him he'd "have to pray on it."
"It was been a nightmare dealing with Best Windows … A lot of promises and none fulfilled," Duncan said.Duncan said that Best Windows has $5,500 for doors that he and his sister wanted installed on Flavor Supermarket and Restaurant on Broward Boulevard.They said they signed a contract for the doors last April, but Best Window did not deliver as promised.Since Duncan had to hire someone else to get the job done, they asked Best Window's owner Rocky Pataky for a refund.When they called Best Window, they didn't get the answer they expected."He told me, 'Rocky wants to give you your money back, but Best Window can't. I have business to do and I have to go pray on it first. When I pray on it, God will let me know what to do. I'll get back to you.' He told me that he was a Christian man," Duncan said.So, the Local 10 Problem Solver Jeff Weinsier confronted Pataky.He said. "Before I allow a contract, from time to time I will pray about different things. It could have been a part of our discussion."Pataky's odd explanation is that it took so long because he wasn't able to get to the area of the store he needed to in order to measure for the doors.Duncan says that's impossible.Pataky then admitted part of it was his fault.Weinsier: "Why did it take so long, April to August?"Pataky: "Many, many missed appointments. I missed some. I missed a couple of appointments that he was there and he missed several I was there."Pataky may also want to pray for better business practices -- the Local 10 Problem Solvers have learned his company has an unsatisfactory standing with the Better Business Bureau. There are 22 complaints.Broward Building Code Services has 25 complaints against Best Window.Weinsier to Pataky: "That's a lot of complaints against a company."Pataky: "That could very well be. Most are within the last couple of years with the code changed. That's part of the problem."But the county and the BBB say a majority of their complaints are for money taken and work not done.As far as Flavor Supermarket goes ...Pataky: "I'll be glad to refund his money, less my cost."But that was two months ago and there has still been no refund.So the best advice from the Problem Solvers: Do your homework before you go window shopping.UPDATE: Late Wednesday afternoon, an attorney for Best Window said the company has now cut a refund check for $3,300 -- the deposit minus permits and engineering costs.
