Miami police said officers saw the stolen Volkswagen Passat driving erratically near Northwest Second Avenue and Northwest 10th Street. When officers attempted to pull over the car, the driver kept going.

Police said the car eventually crashed into a tree. The driver, identified as Bethel, got out of the car with his hands up and was placed under arrest.

Magiera and her two sons, ages 1 and 2, were passengers in the car. Police said the boys weren't properly secured in a child seat.

Bethel faces charges of driving with a suspended license, reckless driving causing property damage, third-degree grand theft and child neglect. Police said Bethel also faces drug charges after cocaine, heroin and marijuana were found in the car.

Magiera also faces a charge of child neglect.
