Victim says driver appeared to be 'under the influence of something'

The victim told deputies that the driver, James Kirkpatrick, 45, "appeared to be under the influence of something because he was not acting right."

The victim said Kirkpatrick took some time to get out of his car, then threw his medication out of the vehicle.

Deputies said Kirkpatrick picked up the medication, got back into his car and hit the victim in the legs with his car as the victim was writing down his license plate number.

Deputies said Kirkpatrick drove away before authorities arrived.

He was spotted by a deputy in the 400 block of Lakes Drive, the report said.

Authorities said Kirkpatrick was found passed out with a can of aerosol computer cleaner in his right hand.

After waking him up, deputies saw that Kirkpatrick had urinated on himself, the report said.

Authorities said he was very disoriented.

Kirkpatrick was arrested on charges of aggravated battery with a deadly weapon, leaving the scene of a crash and failure to use due care.
