FORT LAUDERDALE, Fla. - The mother of a missing Hallandale Beach baby is trying to get the charges of child neglect dropped.

Brittany Sierra was arrested back in January, after it was discovered her son, Dontrell Melvin had been missing since 2011.

Police found what they believe to be Melvin's body in back of a home where she once lived with the boy's father, Calvin Melvin, Jr.

In a Local 10 exclusive, Bob Norman received police reports that indicated the body had blunt trauma to the skull caused by police during the recovery.

"The evidence has been compromised," said Former Broward Medical Examiner, Joshua Perper. "It's going to be a factor for both sides in this case."

He went on to tell Local 10, the damage done during the recovery could cover injuries that occurred prior to death.

Both parents face lesser crimes that could rise to homicide charges if the remains are confirmed to be of Dontrell Melvin.

The defense hearing to dismiss Sierra's charges is scheduled for 8:30 a.m.
