MIAMI – A man appeared in court on Tuesday to face charges for a shooting during a religious event at a house in Allapattah.

Witnesses said someone threw a glass bottle during a fight and there was a shooting on Jan. 6, at 2914 NW 22 Court, according to police.

Surveillance video shows a man who was wielding a gun while fleeing the house in a black BMW, according to police. Two were shot.

One was shot in the abdomen and arrived at Jackson Memorial Hospital’s Ryder Trauma Center. The other was at HCA Florida Mercy Hospital.

During the investigation, detectives reported finding five spent 9 mm casings at the crime scene and two stolen guns in a BMW that was parked at HCA Florida Mercy Hospital.

Inside the BMW, a detective found a 9mm black Smith & Wesson that was stolen on Oct. 23, in Miami-Dade County, and a “silver .38 Colt official police revolver with a wooden handle” that was stolen in 2019, in Miami Gardens, according to the report.

There was also blood in the car and on the ground at the hospital’s parking lot, according to the arrest report.

Police officers later identified Luis Benitez as a suspect and arrested him on Friday, correctional officers booked him on Saturday, and he was at the Metrowest Detention Center on Tuesday without bond.

Benitez, 30, who is Cuban, also has a U.S. Immigration and Customs Enforcement hold records show. He is facing two counts of attempted murder with a firearm and one count of grand theft of a firearm.
