According to the suspect’s arrest report, a driver flagged down a Bay Harbor Islands police officer to report an “erratic driver in a burgundy Buick sedan” that was heading east toward Bal Harbour.

Police said the officer was searching the area for the vehicle when he spotted a male lying face up on the street.

According to the report, the suspect’s vehicle was found a short time later in the area of 96th Street and Harding Avenue.

A witness identified the driver, Samuel Elliot Malave, 54, of Winter Haven, as the person who struck the pedestrian.

Malave was then arrested on charges of leaving the scene of a crash resulting in death and habitual driving with a suspended license.

As of Monday afternoon, he was being held at the Turner Guilford Knight Correctional Center on a $2,500 bond for the driving with a suspended license charge.

His bond had yet to be set for the second charge.
