Jail records show Jovan Lee Moore is facing one count each of aggravated assault with a firearm and improper exhibition of a weapon or firearm.

The incident happened in the parking lot of an apartment complex near the 1200 block of Northwest 58th Street around 11:30 p.m. on May 23.

The victim told Miami police he was walking outside when Moore allegedly came up behind him, racked the slide of a gun, and pressed it against the back of his head.

“I should shoot you,” Moore allegedly said, according to the arrest report.

The victim said he responded, “Go ahead and shoot then,” and closed his eyes, the report stated.

Instead, police said he told responding officers that he heard multiple gunshot go off in an unknown direction. He then turned around, confronted Moore, and eventually walked away to his apartment without any physical injuries.

The victim initially did not report the assault but later went to the Miami Police Department’s headquarters on May 27 to speak with investigators, according to the report.

Authorities said he told investigators that Moore lives in the same apartment complex and that they’ve had prior disputes, though none had ever turned violent until that night.

Police say surveillance footage reviewed Wednesday showed Moore brandishing a gun and pointing it at the victim multiple times in a “threatening and aggressive manner.”

They said the video reportedly showed Moore firing at least one round into the air and repeatedly racking the slide of the gun during the altercation.

Investigators said the footage corroborated the victim’s account and showed no indication that the victim was armed or threatening.

The victim was also able to positively identify Moore in a photo lineup.

Police said Moore was arrested after officers responded to a separate disturbance at his apartment on Northwest 58th Terrace, where they were told by building staff that surveillance footage of the May 23 incident existed.

Detectives later transported Moore to the MPD’s Violent Crimes Office, where he was read his rights and agreed to speak with investigators.

Authorities said Moore made a confession that was redacted in the publicly-released report. A motive for the alleged assault remains unclear at this time.

As of Thursday, he is being held on a $5,500 bond at the Turner Guilford Knight Correctional Center.
