Police officers found the victim injured after the shooting shortly after 6:10 a.m., on Monday, at Southwest Fifth Street, near 27 Avenue.
The victim reported that he was visiting his mother when Hector Baqueda fired at his leg and “racked the slide of the handgun, pointed it at [him] and told [him] that he would kill him and his family,” according to a police arrest report.
The victim also reported that he was able to take the gun away from Baqueda during a struggle and while he ran after Baqueda -- a woman arrived in a red Toyota RAV4 to help him get away, according to police.
At the crime scene, a detective found a 9 mm round with blood spatter, a bullet fragment, and the gun, which Genesis Arias had wrapped in a towel and given to a witness, according to the police arrest report.
Police officers arrested Baqueda and Arias, 30, shortly after 4:40 p.m., on Monday, during a traffic stop at Southwest Eighth Street, and 82 Avenue, in the Westchester neighborhood.
Miami-Dade County correctional deputies booked Arias shortly before 12:20 a.m., and Baqueda at 1:25 a.m., at the Turner Guilford Knight Correctional Center, inmate records show.
Arias appeared in Miami-Dade court on Tuesday morning. She faced a charge of accessory after the fact, a first-degree felony. A judge set her bond at $5,000 and ordered house arrest.
Baqueda faced charges of aggravated battery with bodily harm involving a firearm, a second-degree felony; and using and displaying a firearm while committing a felony, a first-degree felony.
