MIAMI – A Miami man was slated to face a judge Tuesday, one week after police arrested him on an attempted murder charge after they said he tried to ambush his brother, who ended up shooting him in self-defense.

According to Miami police, the shooting happened on Oct. 3 outside of an apartment building in the 5500 block of North Miami Avenue in the city’s Little Haiti neighborhood.

Police said just before 10:30 p.m. a man called up the brother of Lamarc Darver Whack, 22, and told him to “come outside” so he, Whack and Whack’s brother “could all smoke together.”

According to the arrest report, Whack’s brother armed himself before going outside, because Whack had threatened him five days prior.

While outside, Whack’s brother told police that he didn’t see the man, a friend of his brother, but he did see his sibling “hiding in the bushes,” the report states.

Police said Whack then jumped out of the bushes wearing a black ski mask and black hoodie and holding a black pistol.

Whack racked the gun while pointing it at his brother, who then took out his own gun and began firing “in an attempt to save his own life,” the report states, striking Whack several times.

During the tussle, Whack grabbed onto his brother’s shorts and his ski mask slipped, confirming to his brother that he was the would-be assailant, police said.

Whack’s brother ran to a corner store and called police and medics later took Whack to Jackson Memorial Hospital for treatment.

Whack was being held without bond in a secured area of JMH as of Tuesday afternoon, according to jail records.
