MIAMI-DADE COUNTY, Fla. – A Miami-Dade man who was arrested late last year after police said he threatened to kill his ex-wife and forcibly took her cellphone will not face criminal charges, according to a closeout memo obtained Friday by Local 10 News from the Miami-Dade State Attorney’s Office.

Prosecutors declined to file charges against 44-year-old Razvan Gheorghe, citing “insufficient evidence” and the victim’s unwillingness to cooperate with the case.

According to the memo, the victim, who shares a child with Gheorghe, appeared for a pre-file conference on Jan. 7 and told prosecutors she did not wish to proceed with criminal charges.

The memo stated that she also declined to provide a statement or confirm details from his arrest report and said she was “not afraid of the defendant and wants the charges dropped.”

“There were no independent witnesses to the incident,” Assistant State Attorney James McMillian wrote in the memo. “In light of the above facts and circumstances and the lack of the victim’s cooperation with the Miami-Dade State Attorney’s Office, the State would not be able to satisfy its burden of proof beyond a reasonable doubt.”

Records show Gheorghe was arrested on Dec. 9, 2024, following a domestic-related incident at the woman’s home in northeast Miami-Dade.

According to the report, the altercation stemmed from an argument about infidelity.

Officers from what was then the Miami-Dade Police Department said Gheorghe allegedly grabbed the victim by the neck, forcibly took her cellphone and threatened to kill her if she didn’t provide the password.

He was initially booked on charges of strongarm robbery and battery, but both charges were ultimately dropped.

Court records show there were no previous cases of domestic violence between the two parties.
