SWEETWATER, Fla. — A 62-year-old woman couldn’t convince a group of jurors in Miami-Dade County that she was the true victim.
Vivian Hernández was among the residents of the Li’l Abner Mobile Home Park in Sweetwater impacted by a mass eviction.
A representative of the Urban Group called police officers to report that Hernández yelled, sat down, and refused to leave, according to the arrest report.
“People tell us Cubans that when we talk, we are just screaming, but this is my tone of voice,” Hernández said in Spanish, according to a translator in court.
Sweetwater Police Department body-cam video shows how Sgt. Brian Arias arrested Hernández on Dec. 4, 2024, at the mobile home park’s administrative office.
“She began to ... fight, and that’s when I had to take her to the ground,” Arias said in court.
Attorney David Winker, who represented Hernández, said 5,000 were eventually evicted, and she had lived there for more than 15 years.
Miami-Dade prosecutors charged her with three misdemeanor charges: Disorderly conduct, trespassing, and resisting arrest without violence.
The jury found her guilty of all three. Miami-Dade County Circuit Judge Ritamaria Gonzalez Cuervo sentenced her to six months of probation and held her responsible for $358 in court costs.
