MIAMI GARDENS, Fla. — A man accused of firing a shot at another man while he was waiting for his food outside a Miami Gardens Wingstop over a week ago has been arrested, authorities said.
According to the Miami Gardens Police Department, 39-year-old Joshua Irby was taken into custody Thursday and faces one count of aggravated assault with a deadly weapon.
Investigators said the confrontation happened around 11:40 p.m. on Oct. 16 outside the Wingstop located at 21317 NW Second Ave.
The victim told police he was sitting in his gray 2020 BMW X4, waiting for his order, when Irby got out of a black Jeep and began looking into his car while holding a black and silver handgun at his waistband, according to the report.
The report stated that Irby then lifted his shirt to show the gun and threatened to have all the vehicles parked in front of the restaurant towed. When the victim picked up his food and returned to his car, Irby allegedly waved the gun and drove off.
The victim called 911 and followed Irby in an attempt to get his license plate number, police said. Moments later, Irby then fired a shot from his SUV, hitting the victim’s car before driving away, according to the report.
Detectives said they later reviewed surveillance video from nearby businesses and used facial recognition to help identify Irby. They said the victim later identified Irby in a photo lineup.
Police said Irby was arrested Thursday during a traffic stop and admitted to the incident after being read his Miranda rights.
As of Friday, he was being held on a $5,000 bond at the Turner Guilford Knight Correctional Center. No injuries were reported.
The motive behind the confrontation remains unclear at this time.
