Medics quickly took the victim to the hospital in critical condition, authorities said. Police apprehended the 53-year-old suspect, Marc Lermont Yearby, less than an hour later.

The shooting happened at around 11 a.m. in the 1500 block of Northwest 61st Street. It led to a lockdown at the nearby Charles R. Drew K-8 Center.

According to an arrest report, a witness told investigators that the shooting stemmed from a dispute over a woman named “Candy,” whom both men were “involved with.”

Police said the witness recounted that Yearby, of Miami Gardens, came up to them in a white Ford pickup truck a week prior as they were parked on the street. The witness told police that when the victim asked Yearby, “Why do you keep following me?” Yearby said he was looking for “Candy.”

According to the report, the witness said the victim responded, “She is not in my car, and even if she was, why are you coming up to me?“

Police said Yearby replied that “when he sees ‘Candy’ again, he would beat her a--” and then drove off.

Then, on Monday, the report states that the witness told investigators that Yearby again came up to them, leading the victim to open his door and again ask, “Why are you following me?”

According to police, Yearby said, “I’m not following you” and that “Candy” told him “to come over here.”

Police said that led to a “heated argument.” At some point, Yearby was seen “clutching his waistband” and the victim was seen taking out a machete before Yearby opened fire, shooting the victim several times, including at least once in the neck.

The report states that surveillance video showed that while the victim did take out a machete, Yearby shot him only after the victim stopped “several feet away” from him and “cross(ed) his hands in a (non-)aggressive manner.”

Yearby was additionally seen “hovering over the victim and firing a final shot” after he had fallen to the ground, police said.

One of the shots hit a woman’s apartment, according to police, but she wasn’t hurt.

Police said a detective followed Yearby to North Miami and stopped him in the 300 block of Northeast 125th Street.

Yearby faces charges of attempted murder, using a firearm in the commission of a felony, shooting or throwing a deadly missile, felon in possession of a firearm and improper exhibition of a firearm.

He also faces a felony charge of exhibiting a firearm within 1,000 feet of a school.

Appearing in Miami-Dade court Tuesday morning, Yearby was ordered held without bond.

Jail records show he was being held in the Turner Guilford Knight Correctional Center as of Tuesday afternoon.
