MIAMI-DADE COUNTY, Fla. — A 54-year-old man charged in an alleged road rage shooting went before a judge on Monday.
Surveillance video from the incident shows a confrontation that ended with a gunshot on Halloween night near Northwest 87th Avenue and 64th Street in Miami-Dade County.
Now, Emilio Rodriguez is facing a second-degree attempted murder charge. The state says he fired a single shot at Eury Cerda, 27, in an act of road rage.
Audio from Rodriguez’s interrogation shows that he told police he was only trying to scare the victim off, saying he didn’t know Cerda had been struck.
Video from that night shows the victim’s car stops abruptly in front of Rodriguez, who’s in the car with his girlfriend and two grandchildren.
Cerda approaches Rodriguez’s car, and Rodriguez’s girlfriend, Maria Carolina Beltran, testified that Cerda had been driving recklessly just minutes prior and that he tried to open their door multiple times.
Beltran said the children were terrified.
Rodriguez is seen exiting the car and words were exchanged.
Cerda was back by his own car when he was seemingly struck, and then ran away.
Cerda’s mother joined the hearing on Zoom, showing her son still hospitalized, 11 days after a bullet struck his face.
She said he was taking his daughter trick-or-treating the night of the shooting.
The state wanted to keep Rodriguez locked up until trial, but the judge will allow him to go home on house arrest after posting bond, which is still listed as “to be set” on the Miami-Dade County Corrections website.
Rodriguez is expected back in court for another hearing on Nov. 21.
