Officers with the Miami Beach Police Department said the victim was taking a walk on the beach near the 1700 block of Collins Avenue when he sat near a closed lifeguard tower. He was then approached by 24-year-old Jack Daniel Gutierrez, who asked for a cigarette.

When the victim replied that he did not smoke, Gutierrez asked if he could borrow his cellphone, to which the victim said he does not let people use his phone.

The victim initially thought Gutierrez had walked away, but he told police that Gutierrez attacked him from his left side while holding a knife or bladed weapon and pushed him to the ground, according to the report.

The report stated that the victim told police that he attempted to fight Gutierrez and tried to push him away but felt a “puncture to his neck.” He said Gutierrez then jumped off him and fled northbound.

Police said the victim “felt a heavy volume of blood pouring from his neck” as he attempted to apply pressure to the wound.

He then called 911 through a hands-free Siri application on his cellphone, and officers who arrived at the scene noticed that the victim had a cut on his neck extending from ear to ear.

Miami Beach police issued a “be-on-the-lookout” alert and arrested Gutierrez around 4 p.m. Thursday. The victim identified him in a photo lineup.

Detectives said that a records search revealed Gutierrez was on probation at the time of the attack for an unrelated weapons charge.

Jail records show he is facing one count of aggravated battery with a weapon causing great bodily harm.

A motive for the attack is unclear at this time.

As of Friday, he was being held without bond at the Turner Guilford Knight Correctional Center. He is expected to appear back in court on Monday.
