CORAL GABLES, Fla. — A man was sentenced Wednesday to 20 years in prison for a fatal shooting that occurred in 2022 at a Publix in Coral Gables.
Surveillance video shows a fight between the victim, Franklyn Pineyro, 50, and Osmel Lugo-Gutierrez on Feb. 6, 2022, that preceded the fatal shooting.

Lugo-Gutierrez, now 56, claimed that he shot Pineyro in self-defense, but detectives said he approached Pineyro from behind as the two waited in the checkout line.
According to detectives, surveillance video shows Lugo-Gutierrez near a shopping cart when Pineyro, who was in line to purchase lottery tickets, lunged at him with his left arm extended after the two got into a verbal argument.
Lugo-Gutierrez then lifted his shirt, pulled out a 9mm Glock from his waistband, and fired at Pineyro, striking him once in the chest, according to police.
Lugo-Gutierrez was arrested on a second-degree murder charge after the shooting.
“You said it yourself -- you closed your eyes, you had no idea what was in front of you and you pulled a gun in that crowded Publix,” the judge told Lugo-Gutierrez Wednesday.
Wednesday’s sentencing hearing came after a jury found Lugo-Gutierrez guilty of manslaughter.
He faced up to 30 years in prison, but the judge ultimately decided to sentence him to 20 years.
Lugo-Gutierrez’s wife and daughter spoke at Wednesday’s sentencing hearing. The victim’s wife also delivered an emotional statement through an interpreter.
“I miss him so much and I only ask for all the weight of the law to fall on this person,” Pineyro’s wife said. “He killed him without knowing what he was doing.”
Lugo-Gutierrez also took his last chance to address the courtroom and Pineyro’s family.
“It was very hard for me that I acted like that,” he said. “I didn’t want that pain for me or my family.”
