Miami-Dade band teacher accused of forcing himself on students, providing them with vapes

Police: Jose Montes-Guedez kissed 1 of the victims; claimed he provided ‘safe space’ for students

NORTH MIAMI BEACH, Fla. — A Miami-Dade County public school band teacher was arrested last week on accusations that he had “inappropriate relationships” with multiple students that led to him forcing himself on at least two of them, authorities confirmed.

Online jail records show Jose Francisco Montes-Guedez was arrested Friday, just days after celebrating his 40th birthday.

He faces two counts of offenses against students by authority figures, two counts of battery and three counts of contributing to the delinquency of a child.

According to an online school directory, Montes is a teacher at Alonzo and Tracy Mourning Senior High Biscayne Bay Campus in North Miami Beach.

An arrest report obtained Tuesday by Local 10 News states that the investigation into the teacher began in November 2025 after a student told their teacher about an alleged “student-teacher relationship” involving Montes-Guedez and another student.

Police said the student who reported the relationship said they had gotten into an argument with the victim about the relationship which led to a physical altercation in Montes-Guedez’s band room at the end of the 2024-2025 school year.

Police said the victim was then interviewed by a detective and said that while she was not a student in Montes-Guedez’s class, she met him through another student and he allowed her to remain in his classroom during school hours so she could skip some of her classes.

She said he befriended her and gave her relationship advice, authorities said.

According to the arrest report, the victim said she and Montes-Guedez developed a close friendship and he would provide her with nicotine and THC vapes that he had confiscated from other students.

On one occasion, he asked her for a kiss in exchange for a vape pen, authorities said.

Police said the victim claimed that he then asked her for help in one of the small rooms within the band room that did not have a window and then grabbed her by her waist and kissed her on the lips twice.

The victim, who was approaching her 17th birthday at the time, said she pushed him away and then “maintained her distance” from him, authorities said.

During the investigation, the detective was provided the names of two other students that possibly had similar experiences with the teacher.

According to the report, one of those students also claimed that Montes-Guedez befriended her by telling her he had lots of contacts in the music industry, giving her contact information for singing lessons, telling her about his sexual experiences when he was younger and also providing her with vape pens on multiple occasions.

The second victim said he also grabbed her by the waist inside of his office and “pulled her into him,” the report stated.

The victim, who was 17 years old at the time, said she ran out of the room, crying.

According to the report, the third victim also claimed that Montes-Guedez befriended her, purchasing food for her and speaking to her about issues within her family that she was experiencing. She claimed he also asked her and her friends whether they had ever had a threesome and told them about his sexual experiences from college.

He also provided the victim with nicotine vape pens, and offered her THC vapes, which she declined, authorities said.

According to the report, the third victim ended her “friendship” with Montes-Guedez after she learned about the second victim’s experience with the teacher, as well as another friend’s.

The report states that Montes-Guedez told detectives he provided a “safe space” for the three students and several other girls, and claimed they felt comfortable with him and shared details about their personal lives with him.

Further statements he made were redacted from the publicly released report.

A spokesperson for Miami-Dade County Public Schools released a statement to Local 10 News Monday, confirming that Montes-Guedez will be fired.

“Miami-Dade County Public Schools (M‑DCPS) is aware of the arrest of an employee from Alonzo and Tracy Mourning Senior High School by the Miami-Dade Schools Police Department,” the statement read. “M‑DCPS holds all employees to the highest standards of integrity and respect, and this type of conduct will not be tolerated. The District has initiated employment termination proceedings and will ensure the individual is precluded from seeking future employment with M‑DCPS.”

Montes-Guedez faced a judge over the weekend and was ordered held on a $16,000 bond.

As of Tuesday morning, he remained held at the Metrowest Detention Center. If he posts bond, he will be placed on house arrest as he awaits trial.
