The Miami-Dade Sheriff’s Office arrested Giraldo Caraballo, 60, on an aggravated assault charge on Wednesday in connection with the Nov. 10 incident.

According to an MDSO arrest report, the vendor was selling the sweet snacks out of a trailer near the corner of Southwest 195th Terrace and 127th Avenue in the South Miami Heights area when Caraballo, who lives about three-quarters of a mile southwest, approached him.

Deputies said an argument ensued about the man selling churros and Caraballo took a metal baseball bat out of his truck and told the vendor, “If you are here in (15) minutes, I am going to kill you like a dog.”

That caused the victim to be “in fear for his life,” they said.

According to the report, Caraballo came back a “short time later” and told the man, “Oh, you are still here? I am coming back this time.”

Deputies said the churro vendor contacted MDSO and filed a report.

Authorities went to Caraballo’s home on Southwest 200th Terrace on Wednesday to take him into custody and said he declined to speak with deputies.

As of Thursday morning, he was being held in the Turner Guilford Knight Correctional Center on a $5,000 bond.
