GOLDEN BEACH, Fla. — Last week, a Broward County judge ruled it was unconstitutional to fine a Tamarac woman whose car was captured crossing a Sunrise intersection.
The ruling is raising questions about the future of red light cameras being used to fine drivers in Florida.
For now, the decision is limited in reach as other judges could rule differently, but ultimately the Florida Supreme Court end up making a ruling.
“It’s not about safety,” said Bret Lusskin, who was representing that woman from Tamarac. “It was never about safety. It was just about money.”
Lusskin argued the woman’s tickets were illegal because it assumes the registered car owner was also the one behind the wheel.
He argues the state must prove that before it can send out a ticket.
Lusskin has been fighting against the red light cameras for many years. He helped found stopthecams.org, trying to overturn the law allowing people to be ticketed for running red lights.
“These programs, they turn the system on its head and turn drivers into an ATM,” Lusskin said. “Where every time you miss that red light by one tiny fraction of a second, you have to pay up.”
