MIAMI — The retrial of Rashaun Jones will not happen later in May as planned. It is now reset for Sept. 14.
Jones, 40, is charged with second-degree murder for allegedly shooting and killing 22-year-old Bryan Pata in 2006. The two were teammates on the University of Miami football team.
Jones’ first trial ended with a hung jury and a mistrial in February.
At a sounding hearing on Thursday morning, the judge took issue with the timing of several recent motions filed by the defense, which she says were made past a deadline set by the court.
The motions include one which accuses the lead detective in the case of violating a court order by commenting on social media posts of prior trial coverage using a secret Instagram account.
In the end, the judge granted a joint continuance from both the state and defense.
The substance of the motions will be addressed on May 18.
