It happened on April 3 in the northbound lanes of Interstate 95, just south of the interchange with Interstate 595.

Florida Highway Patrol troopers said Aaron McCullough, 33, of Tamarac, lost control of a silver 2017 Chevrolet Malibu, careened across all lanes of the highway and hit the end of a guardrail.

Both McCullough and his passenger, who has not been identified by FHP, were injured when authorities said they hit the car’s windshield.

The victims were taken to Broward Health Medical Center, where McCullough’s passenger was pronounced dead.

Police said a blood draw from McCullough revealed he had a blood-alcohol level well above the legal limit and prosecutors said it took more than five hours before that level fell below the legal limit.

Investigators said they were able to determine that McCullough had been drinking at a nightclub earlier in the evening, with records showing he purchased a bottle of tequila around 9:30 p.m.

Arrested on Thursday, McCullough is facing charges of DUI manslaughter and DUI causing property damage and remains behind bars on no bond.
