An appeals court recently ruled that the agency is not protected by immunity and can be sued over allegations of negligence during the massacre, which left 17 students and staff members dead and 17 others injured.

The lawsuit was filed by survivors and families of the victims.

Former school resource deputy Scot Peterson is among the defendants named in the case. Prosecutors said Peterson stayed outside the building during the shooting and failed to confront the gunman.

Peterson was acquitted of child neglect charges in 2023.

The trial is expected to begin early next year.
