A medical examiner determined Day's cause of death to be asphyxiation.

According to a Palm Beach County Sheriff's Office arrest report, Alvira claimed Day had raped and robbed her, adding that she was forced to bite his penis to free herself.

Alvira explained that she "jumped on top of him and put her hand and knees into his throat," holding him down until help arrived.

However, an autopsy revealed no bite marks on Day's penis, the report said.

"There was no evidence that supports (her) accounts of rape and robbery," the report said.
