Richard Burns, 51, charged with premeditated murder

DAVIE, Fla. – A Davie man remains in the Broward County Main Jail after being accused of killing his 81-year-old mother inside their home.

Richard Burns, 51, is charged with one count of premeditated murder in the death of Patricia Burns.

According to the arrest report, police were tipped off by Richard Burns' brother, William Burns, who asked police to do a welfare check at the home on Sunday after his mother had called him saying she and Richard Burns had gotten into a verbal argument and he stated that he "wished that she was dead," and said he was going to "get AIDS and spit on her."

Officers responded to the home, but nobody answered the door.

William Burns told police he called his brother the next day and was told his mother was dead. He then called 911.

When officers arrived at the home, they found Patricia Burns dead on the kitchen floor with signs of trauma to her head, face and arms. Some of her injuries included two black eyes, a split left ear and multiple wounds on the back of her head.

Police said Richard Burns had red stains on his underwear and hands that appeared to be blood. Plastic bags with bloody clothes from both the mother and son were also found in the attic.

Detectives said Richard Burns denied being involved in his mother's murder, and said someone was probably trying to frame him, although there were no signs of forced entry into the home.

When questioned about the blood stains on his underwear, Burns allegedly said he didn't know how it got there and stated, "What happened between me and my mom is between us and I am not changing my story."
