Trial begins for man accused of attacking FIU student in dorm room

Police say Brandon Allen, 21, held woman down while masturbating on top of her

MIAMI ā€“ A man accused of attacking a fellow Florida International University student inside her dorm room last year will soon learn his fate as his trial began Tuesday.

Brandon Alexander Allen, 21, was arrested April 26, 2015, on charges of false imprisonment, battery and lewd and lascivious behavior by exposing his sexual organs.

According to an arrest report, Allen went to the victim's dorm room uninvited at 2:50 a.m. the same day he was arrested and called her to be let inside.

Police said the woman allowed Allen inside her room, where he began kissing her against her will and making sexual advances.

The student told police that she told him to stop, but he restrained her with his body weight and arms.

According to the report, Allen held the victim down with his arm as he masturbated and then he ejaculated on her back and head area.

Allen testified in his defense Tuesday, claiming that he stopped the moment the woman asked him to.

"I was kissing on her neck. I tried to make a move to go further. She had told me it was too early. It was only our first time hanging out, and I respected that and stopped," he said.

The woman also testified Tuesday and said that Allen had expressed interest in her in the past, but she wasn't romantically interested in him.

According to the victim, who was emotional at times on the stand, Allen lifted her shirt, kissed her in different places on her body and put his hands down her pants.Ā 

"I told him to stop and then that's when he put his body weight on me, so he was lying on top of me and I tried to push him away, so my arms were trapped in between us at that point," she said.

The victim said Allen also grabbed her neck during the incident.

"If I tried to ask him to stop or if I said anything he would cover my mouth, and he was holding me down by my neck so I couldn't move," she said.

Allen's public defender tried to poke holes in the woman's story, asking her why she didn't scream loud enough for her roommates to hear.

"My roommate that was in the kitchen, we didn't get along, and I didn't want her to know that that was happening," the woman said. "I didn't want anybody to know. I was embarrassed."

The victim said Allen left the room after the incident and said, "You happy now? Last time you got your way. Now I'm getting mine."

Allen was arrested by FIU police and taken to the Turner Guilford Knight Correctional Center.

Police said the victim suffered bruising to both sides of her neck from the attack.
