Hialeah police Sgt. Carl Zogby said the shooting occurred about 1:45 a.m. on the side of Okeechobee Road.

According to an arrest report, Pena-Lopez was sitting in his vehicle playing with a gun and waving it around outside the window when it "accidentally discharged," striking friend Javier Enrique Pupo Hernandez in the face.
