Reuters reports two people have filed a lawsuit against the makers of Wise potato chips claiming their bags are sometimes left up to 75 percent empty.

Sameline Alce and Desire Nugent filed the lawsuit in Manhattan federal court on Monday.

In the lawsuit, a 2.75-ounce bag of Wise's Ridgies Sour Cream and Onion chips is shown to be filled only 2.5 inches, despite the bag having a 10-inch capacity.

The report says the proposed class action lawsuit seeks damages for people in New York and Washington, D.C.
