Miami man shoots another man in chest outside restaurant, police say

Jose Guiterrez, 35, says victim grabbed him, was holding bottle

MIAMI – A Miami man was arrested early Monday after he shot another man outside a local restaurant, authorities said.

The shooting was reported just after 12:45 a.m. at the Quisqueya Restaurant at 9513 NW 27th Ave.

Police said the suspect, Jose Gutierrez, 35, arrived at the restaurant with a friend and greeted the victim's friend but did not greet the victim.

According to an arrest report, Gutierrez told police that the victim told him to go outside, so he assumed the victim wanted to speak about why he didn't greet him.

Police said Gutierrez had a handgun in his front pocket and shot the victim in the chest once they were outside.

Gutierrez told officers that the victim had a bottle in his hand and attempted to grab him. He said he shot the victim as he attempted to grab him, the report said.

Police said a witness saw Gutierrez walking to his car after the shooting and approached him. The witness asked for the gun and Gutierrez handed it over while they both waited for police to arrive, the report said.

The victim was taken to Jackson Memorial Hospital's Ryder Trauma Center, where he is listed in critical condition.

Authorities said Gutierrez claimed that he found the gun three months ago in a dumpster.

He said he never touched the weapon until Monday, but knew that it was loaded.

Gutierrez was arrested on charges of attempted second-degree murder and illegally carrying a concealed firearm.
