MIAMI GARDENS, Fla. – Former Miami Dolphins cornerback Xavien Howard is being sued on accusations that he shared sexual images and videos of women without their consent over a two-year period, according to court documents.
The plaintiffs, who were identified in the lawsuit only as Jane and John Doe, made the claims in a lawsuit filed in Broward County back in May.
Jane Doe claims Howard, 30, filmed and took photographs of her performing sex acts without consent and then shared them with her son, who was a minor, in September 2022, according to court records.
The claims alleged that Howard publicly released photos and videos of themselves and other women having sex with him “to humiliate them and cause emotional distress.”
After receiving and seeing the videos, Jane Doe contacted Howard to find out why he shared them.
Court documents show that Howard and Jane Doe were “sexually involved” at one point, but once she “spurned his advances,” he released the “sexually explicit photos and videos without her consent.”
The woman’s attorney, Adriana Alcalde, spoke to Local 10 News about the allegations.
“We know he (Howard) sent these to different people, and we don’t know how many people he sent these to,” Alcalde said.
Both accusers have chosen to stay anonymous, telling their attorneys they don’t wish any harm to Howard. The plaintiffs have requested that he stop sharing the private photos.
Court documents show Jane Doe is seeking judgment for damages in excess of $50,000.
“Some of those videos were taken with her consent, some of them without her consent, but none of them did she ever consent to be disseminated to anyone,” Alcalde.
The plaintiffs’ attorneys sent Howard a cease-and-desist letter back in 2022, but say he continued to send or somehow publish the images.
While Florida statutes protect victims of what’s called “revenge porn” the plaintiffs have not pressed criminal charges against Howard.
“With regards to John Doe he received an explicit photograph of his mother engaged in a sex act with Mr. Howard,” said Cam Justice, who is also representing the plaintiffs in the case.
“Even if you have consent to disseminate the photographs you still can’t send them to minors,” said Alcalde.
Some of the allegations in the suit include invasion of privacy, emotional distress and sexual cyber harassment. It also states that that Jane Doe will “suffer significant losses” due to the videos.
“It’s a constant fear and wonder of what else is out there and who else has seen it? Alcalde asked.
The victims’ attorneys are asking anyone who’s received any photographs from Howard to contact them at 954-515-5656.
Howard, who was released on June 1, is a four-time Pro Bowler and has racked up 29 interceptions in his Dolphins career. He is the longest-tenured Dolphins player on the active roster since being selected in the second round of the 2016 NFL Draft.
He is currently not on an NFL roster and is considered a free agent.
If the case turns criminal, Howard could be charged with sexual cyber harassment, invasion of privacy by public disclosure of private facts and intrusion of privacy.
“Mr. Howard denies the claims and looks forward to prevailing in a court of law,” GrayRobinson Shareholder Ted Craig said in a statement to Local 10 Friday on behalf of Xavien Howard.
