North Miami Beach woman walks in on husband raping her ‘unresponsive’ friend, police say

NORTH MIAMI BEACH, Fla. — A North Miami Beach woman called the police on her husband Sunday night after witnessing him raping her “asleep and unresponsive” friend who was visiting from overseas, according to an arrest report.

According to the North Miami Beach Police Department, the alleged sexual battery happened at around 11:30 p.m. at the couple’s apartment in the 13700 block of Northeast 20th Lane.

The NMBPD report states that the victim, her friend and her friend’s 53-year-old husband, Juan Jose Hernandez, had been drinking and dancing in the living room that night. The victim had been visiting the couple in South Florida for a little more than a week.

Police said the victim fell asleep on the couch and Hernandez’s wife went outside to smoke a cigarette. According to the report, Hernandez’s wife came back and saw her husband raping her friend, “immediately yelled at (him) and physically pulled him away from the victim.”

The report states that the victim “never consented” and awoke to her friend yelling and Hernandez raping her, saying she “immediately” pushed him off.

Police said Hernandez’s wife quickly called the police on her husband.

According to the report, Hernandez claimed that the victim had removed her pajama pants while dancing and pressed against him, but “denied engaging in sexual intercourse with the victim and denied that the victim was asleep at any point during the encounter.”

Officers arrested Hernandez on a sexual battery charge. As of Monday, his bond was listed as “to be set” in Miami-Dade jail records, pending an afternoon court appearance.
