Judge refuses to grant restraining order against chicken owner's neighbor

HOLLYWOOD, Fla. - A Broward Judge says there is no evidence a Hollywood man exposed himself, masturbated or tried to rape his neighbor's daughters.

Judge Michael Kaplan dismissed a temporary restraining order and refused to grant a permanent restraining order against Emerald Hills resident Grant Einhorn.

"This is nothing but revenge," said Sandra Einhorn, Grant's wife.

 "We are relieved it's over. There was and is no evidence. This is what the Kohn's do," added Einhorn.

Leah and Hannah Kohn had accused Einhorn of sexual misconduct and filed for the restraining order 14 months ago.

There have been several hearings in Broward County Court.

The Kohn's and Einhorn's live next to each other on North 51st Avenue in Emerald Hills Section of Hollywood.

"The point of today's hearing was to try to restrain someone from stalking and threatening to rape us," Hannah Kohn told Local 10.

A witness to the alleged incident says the Kohn's claims of sexual misconduct are absolutely false.

Even after the alleged incident of sexual misconduct, the Kohn daughters continued to pace and stand in front of the Einhorn house.

A Hollywood Police Officer testified and said she witnessed the Kohn daughters standing and staring at Einhorn's house.

"I was creeping along and they are still standing at his house," the officer said.

 "If they were scared of him and he allegedly tried to assault them, why would they stand in front of his house every day? said a neighbor who asked not to be identified.

The Einhorn's call it retaliation.

The chicken back story

The Kohn's have been in a battle with the Einhorn's and other neighbors since Sandra and Grant  Einhorn began to complain to the city of Hollywood about foul odors and constant noise.

The Kohn's had chickens and goats living in their back yard.

The city eventually placed liens on the Kohn's house and forced the family to remove the farm animals from the upscale residential neighborhood.

Since then, the Einhorn's claim, they have been the target of harassment and false accusations.

Sandra Einhorn told Local 10 the Kohn's have accused her and her husband of running a meth lab out of their home.

An investigator from the Florida Department of Children and Families showed up at the Einhorn house to investigate allegations their baby was addicted to methamphetamines, but nothing was found.

The Kohn's also filed a Housing and Urban Development complaint against the Einhorn's, claiming they were violation of Fair Housing Act.

Sandra Einhorn says the complaint was eventually withdrawn.

In the past, the Kohn's have told Local 10 their neighbors are anti-Semitic and they are being singled out because their religious beliefs and the way they dress.

Neighbors who didn't want to be identified, in fear of legal retaliation, say it's the Kohn's who are making up lies and stories and creating the chaos on North 51st Avenue and there is video evidence.

Kohns confront Enhorns on camera

Video that aired on Local 10 and has been posted on YouTube  shows Renee Leavy Kohn and several children taunting the Einhorn's as they were walking to a Shabbat dinner one Friday night.

Video also shows several of the Kohn children, wearing all black, pacing up and down on the sidewalk in front of the Einhorn house.

There's also video showing Renee Leavy Kohn coming onto the Einhorn property and throwing herself on the back of Sanda Einhorn's black Audi.

Hollywood Police were called but refused to arrest Renee Kohn.

According to a Hollywood Police report, in May of 2011, Emerald Hills Homeowners Association President Lenora Chuchula accused Renee Leavy Kohn of backing into a friend's car, harassing her and telling her not to testify on the Einhorn's behalf.

Leavy-Kohn was issued a trespass warning and advised not to return to Chuchula's house. 

Another neighbor, who asked not to be identified, says her employer was contacted by the Kohn's on several occasions, making  false accusations in an attempt to get her disciplined or fired.

The Kohn's have also made false allegations about Local 10's Jeff Weinsier.

According to a Hollywood Police report filed in July 2012, Sara Kohn accused Weinsier of following her into a Winn Dixie and stalking her.

Sara Kohn also told police there was a restraining order against Weinsier.

"There isn't or never has been a restraining order against me for anything. It's a downright lie," said Weinsier.

Steve Kohn, the girls' father has accused Weinsier of setting off a flash grenade in their neighborhood and posted video of the incident on YouTube.

Hollywood Police were called and found nothing.

"The information Steve Kohn posted, including the video title, description, and his comments, are patently false and defamatory," said Local 10 Attorney Karen Kammer.

"Nothing in the report establishes Mr. Weinsier or his employer was responsible for, or in any way involved in, this alleged incident.  Mr. Kohn knew, or should have known with the exercise of reasonable care, that the statements contained in his postings are false; they were published with reckless disregard for the truth," added Kammer.

The Kohn's have also filed a multi-million dollar lawsuit against the City of Hollywood, The Hollywood Police Department, Hollywood Mayor Peter Bober, Hollywood  Commissioner Dick Blattner and the Einhorn's.

Steve Kohn and Renee Leavy Kohn, along with their children, say they filed the suit in Broward County Court.

The suit claims a search warrant police executed on the Kohn home on June 8, 2011, was "unlawful" and violated the family's civil rights.

Police seized computers, cameras, telephones, and other items in an investigation into alleged cyber stalking of their neighbors Grant and Sandra Einhorn.

Former Police Chief Chad Wagner and Hollywood Police Department Attorney Joel Cantor are also named in the suit.

The Kohn's are seeking millions in damages.

The City of Hollywood will now have to spend hundreds of thousands of tax dollars to defend the latest suit.
